Or must a human first compile my policy into its lattice, which is where the hard judgement would be hiding? If the second, it is a classifier with a philosophy attached. Nobody has to tell an underwriter that they are blind to agentic behaviour — they filed the form that says so, and the money has already moved. On 1 January 2026 the standard-forms body put three generative-AI exclusions into effect: CG 40 47, CG 40 48 and CG 35 08. A carrier attaching one at renewal is not recording a worry, it is repricing a book — and the insured underneath is paying a premium the size of last year's for a policy that no longer carries the loss its agents are generating. So the blindness is not a claim anybody has to argue; it is paper, with a form number and an effective date, which is why the argument about whether this peril can be measured was settled before any vendor arrived to have it. The entire persuasion half of this category's go-to-market is therefore being spent on the one fact the buyer published first, and the production half — a signal an actuary could put in a rating plan — is the whole of what is left.
A lever needs a fulcrum that does not move, and the exclusion is the only genuinely immovable object in this market. It is dated, it is numbered, it belongs to the buyer rather than to us, and no amount of argument shifts it — which is precisely what makes it useful. The exclusion was the competent instrument, and two independent walls are the reason. The first is Rice's theorem (1953): no program can decide a non-trivial semantic property of another program, so did the agent behave acceptably is not a hard question but an undecidable one — a trigger settled by argument, and nobody writes a policy whose trigger is settled by argument. The second is record conservation: an account of a process, produced by that process, cannot contain what it displaced (Cover and Thomas, Theorem 2.8.1), which closes the obvious escape of reading the agent's own logs. Two unrelated results, so a critic has to break both. Note carefully what that does not say. It does not say the peril should stay excluded, and it does not say verification is hopeless. It says behaviour was always the wrong object, and an exclusion written against the wrong object is the correct move right up until a better object exists.
Change the object and both walls stop mattering, which is the entire move. Fire policies never promised buildings would not burn; they made fire a number. The insurable object here is deviation from a lane declared before the run — a boundary crossing, counted against a sealed declaration the actor could not revise afterwards, recorded in a record the actor did not write. That is decidable where behaviour is not, countable where quality is not, and it is the same trade this market has made in every peril it eventually learned to underwrite. We never guarantee behaviour. We guarantee the deviation is detected, placed, priced and dispatched — four verbs, and not one of them is a promise about conduct.
One concession, stated before anybody has to extract it — and it is the opposite of a dodge. You were right to.
That is the whole of the opening and it is not a rhetorical manoeuvre. When a peril cannot be measured, excluding it is the correct actuarial response, and the standard-forms body reached that conclusion with more discipline than any vendor in this category has shown since: CG 40 47 removes bodily injury, property damage and personal-and-advertising injury arising out of generative AI across Coverages A and B; CG 40 48 does Coverage B alone; CG 35 08 takes products and completed operations. Effective 1 January 2026, attached at renewal, form by form. Cyber sits separately and messier — there is no single standard form there, and carriers are adding affirmative AI endorsements, exclusions and condition-precedent clauses individually, which is its own kind of tell.
What follows from that is smaller and stranger than it looks. The market's own paper is the strongest available evidence for the claim every AI-risk vendor spends its first page trying to establish, which means the establishing was finished before any of us arrived. A pitch whose opening act is you cannot see agentic behaviour is quoting its buyer back to themselves, slowly, as though it were news. The interesting question was never whether the blindness is real. It is what a signal would have to look like to be consumed by somebody who already knows.
The exclusion is not the objection to this argument. It is the citation for it. A market that files a numbered form declining to carry a peril has published a measurement problem more precisely than any deck ever will — and has thereby also published exactly what it is missing.

The objection an underwriter reaches for here is the right one, and it is that uncertainty is not an obstacle to this trade — pricing things nobody can predict is the entire profession. Hurricanes are unpredictable and hurricane cover is liquid. So the wall cannot be uncertainty, and it is not.
The wall is that the trigger would be adjudicated by argument. A hurricane policy pays on a windspeed at a coordinate: the loss is uncertain, the trigger is not. A policy on the agent behaved acceptably has an uncertain loss and a trigger that two competent experts can read opposite ways forever. Rice's theorem (1953) says that is not a tooling gap — no program decides a non-trivial semantic property of another program, in general, at any budget. If it is debatable it is semantic, and semantic is not insurable, because nobody writes a policy whose payout is settled by an argument between two consultants.
The second wall is the one that closes the obvious workaround. Just read the logs fails because a log is an emission from inside the boundary: an account of a process, produced by that process, cannot contain what it displaced. There is a version of this argument, popular in the sector, in which insurers are the laggards holding progress back. It is wrong in a way that is easy to check. This industry's own history is the counterexample: in 1866 a group of engineers chartered a company whose product was inspection, not indemnity — the Hartford Steam Boiler model, where the boiler explosions stopped because somebody went and looked, and the insurance followed the looking rather than replacing it. Munich Re still carries that lineage. The instinct to refuse a peril you cannot inspect is the founding instinct of the discipline, not a failure of nerve.
Which is why the last two years have been so odd from your side of the desk. What has arrived is guardrail software, evaluation suites, red-team subscriptions and a great deal of language about alignment — all of it aimed at making the agent better, none of it producing anything you could put in a rate filing. Nobody has brought you a number. They have brought you assurances, and an assurance is the exact substance your profession exists to convert into something else.
The sector already made this argument in the other direction, at the deployer: the exclusion is the liability — the carve-out does not delete the exposure, it relocates it onto a balance sheet with no reserve behind it. An exposure base is the thing a rating plan multiplies by. Payroll for workers' compensation, receipts for products liability, vehicle-years for auto. The reason no AI rating plan exists is not that carriers lack appetite — it is that nobody has proposed an exposure base with a countable unit behind it. Seats are not it, because seats do not act. Model calls are not it, because a call is not a decision. API spend is not it, because spend measures enthusiasm.
The unit on offer is a declared-lane crossing, per agent-year. An operator declares the lane before the run and seals the declaration; the run happens; a boundary crossing is counted against the sealed declaration by a process the operator does not control; the count is a pure function of an immutable record, so anybody holding that record recomputes the same number. Crossings per agent-year is an exposure base with the shape your existing plans already have — a countable numerator over a time-denominated exposure — and that shape is not an accident, it is the requirement working backwards.

The fear that makes people call this peril uninsurable is not the loss size — it is adjudication cost. Every AI claim, the reasoning goes, becomes a two-year fight about whether the model, the prompt, the fine-tune, the vendor's token bias or the user caused the outcome. That fight is expensive, it is unwinnable, and a line of business whose claims cannot be settled cheaply is not a line of business.
The count is cause-blind, and that is the property rather than a side effect. A prompt injection, a hallucination, a hidden trigger and a vendor's silent model swap all produce the same thing at the boundary: a crossing out of the declared lane. Same event, same tick, same arithmetic. So the attribution argument never has to be won in order for the trigger to fire — which inverts the usual relationship, because the very undecidability that made behaviour uninsurable is what makes the crossing cheap to adjudicate. You are not asked to determine why. You are asked whether the run left a lane that was declared before it started, and that is a set membership question with an answer.
The corollary is worth stating plainly because it cuts against us: this instrument can never tell you the deployment was safe, and a version of it that claimed to would be worth less, not more. Here is the hostile read, in its strongest form, which is that the author of this post filed a patent on the measurement he is telling you the market needs. US 19/637,714, filed 2 April 2026, thirty-six claims, seven provisionals behind it. That is exactly the incentive structure that produces a confident diagnosis of a problem shaped like one's own invention, and anybody who ignores that when reading this is not doing diligence.
The answer is a chronology rather than an adjective. The exclusions were filed by ISO and took effect on 1 January 2026 — three months before the non-provisional, and by a body with no interest whatsoever in this patent, this company or this argument. The blindness is documented by a party that gains nothing from documenting it, which is the one form of evidence a motivated author cannot manufacture. The patent covers a proposed instrument; the exclusion establishes the gap. They are different facts with different authors and different dates, and only one of them is ours.
What that chronology does not do is establish that our instrument is the right one, and we are not going to blur those together. The honest remaining hole is adoption, not physics: nothing here has been through a carrier's actuarial review, no rating plan currently consumes this count, and the reason to run it yourself rather than believe a paragraph is precisely that. The argument that AI risk becomes writable the moment the count exists is ours and we will defend it; the claim that it has already happened is not one we make.

Every receipt this system emits carries the same contract, in the same words, and it is worth reading as an underwriter because it is written in your grammar: where this landed is provable and re-runnable; whether it is bug-free is undecidable, and we do not claim that. A projection that does not declare what it is sufficient for is a false green waiting to happen, so the declaration rides on the artifact rather than in the marketing around it.
The sentence we will not say is the one this category says constantly: that the instrument keeps the agent in lane. It does not, and the refusal is structural rather than modest. A box built from rules about what the agent might do is specified under the assumptions now being violated, which is why every containment story eventually discovers that. The halt is a different thing: a count written by the floor sits outside the agent, and you can wire the first off-lane tick to a hard halt on your own machine. That wire is yours. The count it reads is what we sell. We never guarantee behaviour. We guarantee the deviation is detected, placed, priced and dispatched. A sprinkler exists and a building may fit one; the policy still never promises the building will not burn, and nobody in your profession finds that a weakness.
There is a second sentence we decline, and it is the one you would be right to test us on: we do not predict what any underwriter will require or exclude next. That is a claim about somebody else's future decision, and one carrier saying I would write that ends it. What is checkable is what was filed, on which date, under which number — and the useful consequence is a change in the object of the lockout. You can deploy. The reason this is not a thought experiment is that renewals have dates. Every account that attaches one of the three forms after 1 January 2026 produces a scheduled moment in which somebody — a broker, a risk manager, a board member who actually read the endorsement — asks the obvious question: what would we need in order to write this back? That question arrives regardless of whether anyone prepared for it, which makes preparation the only variable actually in play.
There is currently no answer on the shelf, and the shape of the missing answer is now specific rather than vague. Not a safety claim, which is undecidable and which no serious carrier would accept anyway. Not a vendor attestation, which is a log from inside the boundary and therefore excluded by the second wall. What is missing is an exposure base with a countable unit, a trigger that fires without an attribution fight, and a record written by a hand the actor does not control — three requirements, all of them yours before they were ever ours, and all three derivable from the paper your own industry filed.
The count does not make the peril safe and does not claim to. It makes the peril writable, which is a much smaller and far more useful thing, and it is the same conversion this market performed on marine cargo, on fire, and on boilers after 1866 — every one of them uninsurable right up until somebody built the instrument that counted the thing, and ordinary the year after.
