Thirty years of litigation — Tyco, Altria, AIG — and every case I've ever tried came down to the same object: the record made at the time. eDiscovery built an industry on reconstructing intent from fragments after the fact. Now companies are deploying AI agents that generate millions of actions and precisely zero contemporaneous records — and I know exactly what that looks like five years later in a courtroom: an evidentiary vacuum both sides fill with experts.
