Two years of narrowing indemnification paragraphs. That's my actual AI practice: shrinking the sentence my name sits under, because I know what the deal team won't put in writing — nobody can prove what a model will do. Not the vendor, not the client, not me. Every disclaimer I've drafted is a memo establishing that we knew. Then someone shows me an ordinary code commit that files its own evidence: a receipt of where every change landed, computed with no AI in the loop, re-runnable by opposing counsel. My stomach drops, because I know this case. It's T.J. Hooper — the tugboat that sank without a radio. The moment a reasonable precaution exists at reasonable cost, every client without it is negligent per se, and the standard of care moves whether the industry likes it or not. Someone is going to be the counsel who names that standard first. I'd rather it be me than the plaintiff's expert.
That's the target: you recognize your own voice in it, or you don't. If it misses, the miss is mine — tell me where it broke. It's tuned against the live repo and keeps changing.
